This page explains our current approach based on the services and technologies identified. Project-specific agreements may add further obligations.
1. Agreement and scope
These Terms govern your use of the AMAiRA Technologies website and any proposal, statement of work, subscription or service agreement that incorporates them. AMAiRA Technologies is registered in Malaysia as AMAiRA Technologies (Registration No. 202603225774 (LA0092684-D)).
By accessing the website or requesting services, you agree to these Terms. A project begins only when the parties accept the applicable proposal, scope, commercial terms or other written agreement. If a project document conflicts with these Terms, the project document prevails for that project to the extent of the conflict.
2. Services
Our services may include custom website design and development, mobile application development, workflow and software automation, digital system integration, UI/UX design and IT consultancy. Deliverables, milestones, dependencies, acceptance criteria, support coverage and fees are defined in the applicable written scope.
3. Client responsibilities
- Provide accurate requirements, authorised contacts, timely decisions and lawful access to required systems.
- Ensure that client materials, datasets, credentials and instructions may lawfully be supplied and used for the project.
- Review deliverables and provide consolidated feedback within agreed timelines.
- Maintain secure control of accounts, credentials and devices under the client's responsibility.
- Obtain notices, consents and permissions required for client-controlled personal data, marketing or third-party platforms.
- Use delivered systems lawfully and according to documentation and agreed technical limits.
4. Accounts and Facebook Login
Where an account or Facebook Login is available, you are responsible for activity performed through your account and for maintaining account security. You must not impersonate another person, share access unlawfully, circumvent security or use login data outside the intended service. We may suspend access where reasonably necessary to protect users, systems, data or legal compliance.
5. Acceptable use
- Do not probe, attack, overload, disrupt or bypass security controls without prior written authorisation.
- Do not upload malware, unlawful content, infringing materials or personal data obtained without authority.
- Do not use our services to deceive, harass, discriminate, facilitate unlawful surveillance or violate platform rules.
- Do not reverse engineer protected components except where the restriction is prohibited by law.
- Do not use AI or automation features for decisions requiring professional or human judgement without appropriate review and safeguards.
6. Third-party platforms
Projects may depend on Meta, WhatsApp, Google, hosting providers, app stores, payment services, APIs or other third parties. Their services are governed by separate terms, permissions, quotas, reviews and availability. You must maintain required third-party accounts and comply with their policies. We are not responsible for a third party changing, restricting or discontinuing its service, but we may offer reasonable assistance under an agreed support scope.
7. Fees, taxes and changes
Fees, deposits, recurring charges, payment dates, taxes and reimbursable costs are stated in the applicable proposal or invoice. Additional work caused by scope changes, missing dependencies or new requirements requires written approval and may affect fees and timelines. Overdue amounts may result in paused work or access where permitted by the applicable agreement and law.
8. Intellectual property
Each party retains ownership of intellectual property it owned before the project. Unless a project agreement states otherwise, ownership or licence rights in custom deliverables transfer only after full payment. AMAiRA Technologies retains rights in reusable know-how, frameworks, development tools, generic components and methods, subject to protecting client confidential information. Third-party and open-source components remain subject to their own licences.
9. Data and confidentiality
Each party will use reasonable care to protect confidential information received for the project and will use it only for authorised purposes. Personal data will be handled according to the applicable project terms, our Privacy Policy and data protection law. Clients remain responsible for defining lawful purposes and instructions where AMAiRA Technologies processes personal data on their behalf.
10. Warranties and acceptance
We will perform agreed services with reasonable care and skill. Technology cannot be guaranteed to be uninterrupted, error-free or immune from every cyber threat. Any warranty, defect correction period, service level or acceptance procedure must be stated in the applicable project agreement. Preview, prototype and demonstration materials are not production deliverables unless expressly accepted as such.
11. Limitation of liability
To the maximum extent permitted by applicable law, neither party is liable for indirect, incidental, special or consequential loss, including loss of profit, opportunity, goodwill or data, arising from the website or services. Any aggregate liability cap should be set in the relevant project agreement. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
12. Suspension and termination
Either party may terminate according to the applicable project agreement. We may suspend affected services for serious security risks, unlawful use, material breach or non-payment where permitted. On termination, outstanding fees remain payable, and each party must return or securely handle confidential information and data according to the agreement and law.
13. Governing law and contact
These Terms are governed by the laws of Malaysia. The parties should first attempt in good faith to resolve disputes through written discussion before pursuing available legal remedies.
